SuperBoard Terms of Use

Welcome to SuperBoard ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website, Chrome extension, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, installing the Chrome extension, or otherwise using the Service, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy.

2. Eligibility

  1. Age Requirement: You must be at least 13 years old (or 16 in certain jurisdictions) to use the Service.
  2. Authority: If you are using the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

  1. Account Creation: To use certain features, you must create an account by providing accurate and complete information.
  2. Credentials: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  3. Security: Please notify us immediately of any unauthorized use of your account or any other breach of security.

4. Subscriptions & Payment

  1. Free Plan: We offer a free plan that includes certain usage limits (e.g., 1 board, 10 widgets, no auto-refresh).
  2. Paid Plans: For additional features (e.g., unlimited boards, auto-refresh, historical tracking), you may subscribe to a paid plan. Payment processing is handled by Paddle on our behalf.
  3. Billing Cycle: Paid subscriptions renew automatically at the end of each billing cycle unless canceled.
  4. Cancellation: You may cancel your subscription at any time. Your account will remain active until the end of the current billing period.

5. License & Use of the Service

  1. Limited License: Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.
  2. Restrictions: You agree not to:
    • Modify, reverse engineer, or create derivative works based on the Service.
    • Use the Service to upload or transmit unlawful or infringing content.
    • Attempt to disrupt or compromise the integrity or security of the Service.

6. User-Generated Content ("Snips" & Boards)

  1. Ownership: You retain all rights to any content you capture and store using the Service.
  2. Responsibility: You are solely responsible for any content you upload, display, or otherwise make available through the Service.
  3. Prohibited Content: You may not capture or store content that is illegal, harmful, or violates any third-party rights (including intellectual property rights).

7. Intellectual Property

  1. SuperBoard IP: All trademarks, logos, and other intellectual property related to SuperBoard are our exclusive property.
  2. Feedback: Any feedback, comments, or suggestions you provide may be used by us without any obligation or restriction.

8. Third-Party Services

  1. Links & Integrations: The Service may contain links to or integrations with third-party websites and tools (e.g., Paddle for payment, Supabase for data storage). We do not control these services and are not responsible for their content or practices.
  2. No Endorsement: Inclusion of a third-party link or tool does not imply endorsement or affiliation.

9. Termination

  1. By You: You may stop using the Service at any time. If you wish to delete your account, please do so via your profile settings or contact us.
  2. By Us: We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service.
  3. Effect of Termination: Upon termination, your right to use the Service immediately ceases. We may delete your data after a reasonable period or as required by law.

10. Disclaimer of Warranties

  1. As-Is: The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. No Guarantees: We do not guarantee that the Service will be error-free, secure, or available at all times.

11. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

  • Your access to or use of (or inability to access or use) the Service.
  • Unauthorized access, use, or alteration of your content.

Our total liability for all claims arising out of or relating to the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the event giving rise to the liability.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, or expenses (including legal fees) arising out of your violation of these Terms or the rights of a third party.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Serbia, without regard to conflict of laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Serbia, and you consent to such jurisdiction and venue.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make significant changes, we will notify you by posting the revised Terms on our website and/or sending an email to the address associated with your account. Your continued use of the Service after such changes indicates your acceptance of the new Terms.
